DrumWave Privacy Notice

This privacy notice is intended to notify you of the data privacy practices of DrumWave, Inc. (“DrumWave,” “we,” “us,” and “our” etc.), regarding information we retain from our internet software platform (the “Platform”), web page https://www.drumwave.com, and our various social media, marketing and public relations, and other practices described in this notice (the “Services”).

Personal Information We Collect

When you interact with us through the Services, we may collect personally identifiable data and other information by which you might not be personally identifiable (the “Personal Data”) from you.

  1. Personal Data That You Provide Through the Services 

You may voluntarily provide Personal Data when you interact with us including through the Services, such as your contacting us with inquiries, responding to a survey, registering for or using certain Services. The Personal Data you may provide to us might include:

When you interact with DrumWave through the Services and/or the Site, the various technologies used in connection with the Services and/or the Site collect and store certain information. Alone or in combination with other information, such automatically collected information may constitute Personal Data. This automatically-collected information includes:

  2.  Internet Service Provider;
  3. Your interaction with the Site; and
  4. The site from which you came to the Site and the Site to which you went from the Site.

We may ourselves store automatically-collected information, or such information may be included in databases owned and maintained by DrumWave’s third party affiliates, agents, or service providers. The Services may use automatically-collected information and pool it with other information.

The Purposes for Which We Use Information about You

Data Subject Rights

  1. Requests to Know

Because some of the Personal Data is personally identifiable information, you have the right to know, access, and in some cases by law correct or delete:

  1. The categories of Personal Data we have collected about you;
  2. The categories of Personal Data about you we have disclosed or shared;
  3. The categories of sources from which we have collected Personal Data about you;
  4. The business or commercial purposes or collecting Personal Data about you;
  5. The specific pieces of Personal Data collected;
  6. Other access rights as specified under applicable law.

Requests may be emailed to [email protected]. The delivery of our response may take place electronically or by mail. We are not required to respond to Requests to Know more than twice in a 12-month period.

  1. Requests to Delete

You have the right to request that we delete any Personal Data about you that we have collected. Upon receiving a verified request to delete Personal Data, we will do so unless otherwise authorized by law. Requests may be emailed to [email protected]

You may designate an authorized agent to make requests on your behalf. You must provide an authorized agent with written permission to submit a request on your behalf, and we may require that you verify your identity directly with us.

Upon receipt of a request and in order to protect your privacy and the security of Personal Data about you, we may ask you for additional information to verify your identity. Any additional information you provide will be used only to verify your identity and not for any other purpose. We will acknowledge the receipt of your request within ten (10) days of receipt. Subject to our ability to verify your identity, we will respond to your request within 45 days of receipt. By law we may be permitted to request an extension of time to respond.

  1. The Right to Non-Discrimination

You have the right not to be discriminated against for the exercise of your California privacy rights.

Exclusions

This Privacy Notice does not apply to any Personal Data collected by DrumWave other than Personal Data collected through the Site and/or the Services. This Privacy Notice shall not apply to any unsolicited information you provide to DrumWave through the Services or through any other means. 

Children

DrumWave does not knowingly collect Personal Data from children under the age of 16. If you are under the age of 16, please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Notice by instructing their children never to provide Personal Data on the Services without their permission. If you have reason to believe that a child under the age of 16 has provided Personal Data to DrumWave through the Services, please contact us, and we will endeavor to delete that information from our databases.

Security

DrumWave uses several security mechanisms to provide confidentiality, integrity and availability to your personal data, always supported by the strictest standards practiced by the market.

It should be noted that your password to access the account is personal and non-transferable, and you should never share it with third parties.   

If You identify or become aware of anything that compromises the security of Your data, it is essential that You contact DrumWave immediately. 

Right of Access

You have a legal right to request the personal information about you held by us. On request, we will provide you with a copy of this information. You also have a right to correct, amend or delete such personal information where it is inaccurate or has been processed in violation of the EU-U.S. DPF Principles.

Changes to DrumWave’s Privacy Notice

The Services and our business may change from time to time. As a result, at times it may be necessary for DrumWave to make changes to this Privacy Notice. DrumWave reserves the right to update or modify this Privacy Notice at any time and from time to time without prior notice. Any changes to this Privacy Notice will be made directly on our website or platform. Please review this notice periodically, and especially before you provide any Personal Data. This Privacy Notice was last updated in October 2024. Your continued use of the Services after any changes or revisions to this Privacy Notice shall indicate your agreement with the terms of such revised Privacy Notice.

Retention of Information; Access to Information; Contacting DrumWave

To preserve the integrity of our databases, we may retain information submitted by Visitors for an indefinite length of time as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. If required by law, we will delete Personal Data by erasing it from our database. We will also respond to Visitors’ requests to delete or correct accounts or Personal Data, which you can do by contacting DrumWave at [email protected].
